Refusal of Tour Participants
Travel Legacy Inc. reserves the right to refuse to accept or retain any person as tour participant and to make changes and substitutes in any itinerary of its group travel as it deems necessary for the comfort, safety, or the convenience of the group travel participants and the proper carrying out of the event, and to withdraw any or all tours announced in this program should conditions warrant. If a tour is cancelled, a refund for that portion of the vacation to the participant will constitute full settlement.
Please report any disability requiring special attention to Travel Legacy, Inc. at the time the reservation is made. Travel Legacy, Inc. will make reasonable attempts to accommodate the special needs of disabled traveler, but is not responsible in the event it is unable to do so, nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. With Disabilities Act is only applicable within the United States and facilities for disabled individuals may be limited in other countries. We regret that we cannot provide individual assistance to a vacation participant for walking, dining, getting on and offer motor coaches and other vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance and must assume full responsibility for their well-being. The passenger assumes the full risk of use and of any prohibitions imposed by vendors.
Passports
A passport is required to travel outside the United States. The passport needs to be valid for at least 6 months beyond the conclusion of your trip. You should apply and obtain a passport far in advance for any group travel outside the United States. Failure to receive a passport by the travel date is not grounds for refund of any payments made. Accommodations
The accommodations listed with our group travel packages are intended to be used with each tour. If changes become necessary for any reason, the accommodations substituted will be equivalent in standard to those shown. Unless otherwise requested, we will book non-smoking rooms. Please note that hotels cannot always guarantee smoking rooms. Hotel room location is at the sole discretion of the hotel. Requests can be made but are not guaranteed.
Suppliers
The carriers, accommodations, and other suppliers providing services are independent contractors and are not agents or employees of Travel Legacy, Inc. Travel Legacy Inc. and Don Money Entertainment assumes no responsibility and will not be held liable for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity by reason of (1) any wrongful or negligent acts or omissions on the part of its suppliers, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of an employee of these suppliers, (3) any defect in or failure of any vehicle, equipment or instrument owned, operated, or used by any of these suppliers, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the control, direct or otherwise, of Travel Legacy, Inc. or (5) act of God.
Release of Liability, Hold Harmless
In consideration of the opportunity to participate in the above named event on dates indicated above, I voluntarily acknowledge and agree to the following: I agree for myself, my heirs and assigns, executors and administrators to hold harmless and release Travel Legacy, Inc., or any other sponsoring organization(s) and/or subsidiaries, affiliates, officers, representatives or successors (released parties”) from any and all losses, causes of action, liabilities, indirectly from participation in connection with the Event and/or the condition of the property, facilities or equipment used for Event, regardless of when, where or how such claim may arise and regardless of whether caused by the disappearance of negligence of the Released Parties or otherwise, including, without limitation. Claims relating to (1) any theft, loss or disappearance of property, (2) bodily injury (fatal or non-fatal) and (3) property damage.
Image Release
I grant permission for Travel Legacy, Inc. to use my likeness and any other indication of my identity in connection with the Event, and publicity, advertising and promotion for the event and other events in all forms of media throughout the world in perpetuity without remuneration I further agree that all photos, negatives, imagery and video recordings and all copyrights therein shall be the sole property of Travel Legacy, Inc. and I waive any right I may have to inspect or approve any materials that may use such rights.
Agreement Enforceability
The agreements will be constructed broadly to prevent claims and law suits to the maximum extent permissible under applicable law. Any provisions found to be void or unenforceable shall be modified or deleted to the minimum extent necessary to make them enforceable, and shall not affect the enforceability of any other provisions.
Terms & Conditions - The Basics
Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner.
T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).
T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.
What to Include in the T&C Document
Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
